ALBUQUERQUE, N.M. -- The woman who police said admitted to smothering her son at an Albuquerque Park made
her first court appearance Friday. Police unearthed Tyrus Toribio's body one week ago. The child was unidentified for five days, only known to the public
as Baby Angel. But on Thursday, police made a break in the case when tips lead them to 23-year-old Tiffany Toribio. According to Toribio's arrest
warrant, she confessed to taking her son Tyrus to Alvarado Park on May 12. The warrant reads, "Tiffany started to push down on Tyrus's face plugging
his nose and mouth with her hands. Tyrus started to squirm and stopped breathing. Tiffany started to revive Tyrus by giving him CPR. Tiffany then held
Tyrus's nose and mouth again until Tyrus stopped breathing." Police said Toribio then dug a hole in the sand at Alvarado Park and buried her dead
son. Friday, Toribio faced a judge at Albuquerque's Metropolitan Court to answer to charges of first degree murder and failing to report a death.
She's being represented by Leila Hood, a public defender in the Capital Crimes Unit. An attorney from the district attorney's office tried to argue
in court, but Judge Cristina Jaramillo interjected. "May I ask why the state is here for this particular case when the state has stated they don't
want to be here for first felony appearances?" Jaramillo asked. "I don't know the answer to that, your honor," the attorney said.
"Then, we'll move on the defense, thank you," Jaramillo said. Hood agreed Toribio should be held on a $250,000 cash only bond. The district
attorney now has 10 days to send the case to a grand jury for an indictment. If that doesn't happen in that time frame, the Metropolitan Detention Center
may have no choice but to set Toribio free.

Set her free!?!?!?! What the #$^%? Granted, I have known our judicial system was screwed up for awhile. But hearing these stories just makes me want to throw
things. This is terrible!

How very sad for the little one and for the mother. It makes you wonder what she grew up with herself to end up so callous and deadly to her own little one. He
was just over three years old ... it would have been a horrific way for him to die.
I've just read another article linked to the story which sheds more background on both of them. The mother was asked why she killed him and her answer was ... "Tiffany said that she did not want him to grow up with no one caring about him, the same way that she had grown up with nobody caring about her." The rest of the article can be read HERE It's just so tragic. We've just recently had a woman set free after killing her month old baby by smothering him. She had a history of depression, went off her tablets in order to get pregnant at 39 but didn't tell her husband or her doctor that she'd gone off them. There were signs pointing to the fact she was suffering from PND but no-one including her doctor or family did anything to help her. While I was angry that she killed her own tiny baby after years of trying IVF etc ... I was saddened that she cried out for help but no-one took her seriously.

People ARE 'tried' on the opinions of people who DO read news accounts and watch television reports Sweetgherkin. Sure the jurors for this impending
case may not be members of this online board or any other you may venture into however jurors ARE normal human beings who DO read news accounts and who DO have
opinions ... perhaps even similar opinions to those of us in here. Jurors are meant to be impartial of course but you'd have to be pretty non-plus about
life not to be affected in some way by the death of a child at the hands of its own mother. I've already stated above that I think its sad what happened
both for the child and the mother. I for one wouldn't want to be called onto the jury for that particular case.

Unfortunately for the public, we don't have the final decision. Writing our opinions in bold does not make them any more true. We don't get to put the person on trial ourselves, even though many people seem to believe they would be both brilliant judge and perfect jury at the same time. What one person would you trust that with, if you were the one on trial? Wouldn't you think it was fair to have 12 + 1 who are supposed to believe in you, "innocent until proven guilty"? |

No-one in here is claiming that a statement typed in bold lettering makes them any truer Sweetgherkin. The person is not on trial in here as you well know ...
people are merely expressing their opinions as you yourself are. None of us are on the jury and I'd like to think if one of us was ... we'd still
approach the trial with the same open mindedness that jurors are expected and instructed to have. The woman confessed to killing her own child so it's not
a case of 'innocent until proven guilty'. I'm assuming in this case it will be whether it was premeditated or due to circumstances of the moment.
